New vegetation clearing rules for bushfire prone areas
The 10/50 Vegetation Clearing Code of Practice, which relates to the clearing of trees and vegetation on bushfire-prone land, has recently come into effect for New South Wales.
This means owners of properties within the entitlement area can remove any tree (over a height of three metres) that is within 10 metres of a habitable dwelling, or any vegetation under three metres (such as shrubs and plants) that is within 50 metres of a habitable dwelling, without requiring consent.
Vegetation may only be cleared in accordance with the 10/50 rules as set out in the Code of Practice.
For more information, or to check if your property is in a 10/50 area visit the Rural Fire Service website.
Wyong Council Tree Removal Policies
Council’s tree policy has recently changed, making it easier for landowners to remove trees on RESIDENTAL properties.
What has changed?
A landowner can now remove any tree or vegetation on a residential property (less than 1500m2) without an application to Counci, UNLESS the tree is a protected species or the property is heritage listed under Schedule 5 of Council’s Local Environment Plan,
If the residential property is larger than 1500m2, trees can be removed within 12 metres of any approved structure (meaning a house, garage or shed), unless again it is listed under Schedule 5 of Council’s Local Environment Plan,
To remove a tree further than 12 metres from a structure – an application is required. You will need to download the Tree Works Application and fill in the applicable fields. Take a look at the sample tree application plan (433.04 KB) to help you fill out the form.
